IF THE POLICE WANT TO TALK TO ME BUT I HAVE NOT BEEN ARRESTED, ACCUSED OR CHARGED WITH A CRIME, DO I STILL NEED AN ATTORNEY?

Yes, you should consult with an attorney before making any statement. What you say, no matter how well intentioned, can be misinterpreted and may be used as evidence against you later.

Even though you are not accused or charged with a crime, you may, nevertheless, be a suspect while law enforcement carries out their investigation.

WHAT SHOULD I KNOW IF I'M ARRESTED?
 
Advise the officer that you wish to remain silent. Not answering a police officer's questions is your constitutional right.

Giving a statement to law enforcement is the single most damaging thing you can do for your case. 

Do not agree to any search, or turn anything over to law enforcement. If presented with a search warrant, do not resist. 

Do not talk about your case with your family, friends, or anyone in jail.  Anything you tell them can and probably will be used against you.

Do not represent yourself. The prosecutor on your case is an experienced attorney who knows the law better than you do.

Do not go to court without first talking to an attorney. Anything you tell your attorney is confidential and cannot be used against you.

Do not sign anything without talking to an attorney.
